Micro dotting and Vehicle Dealing

SUBJECT:  NOTICE OF POSSIBLE  CONTRAVENTION OF LEGAL REQUIREMENTS  RELATED TO  MICRODOT FITMENT AND RECORD-KEEPING OBLIGATIONS

Second-Hand Goods Act – Microdot Recording Obligations

In addition, Section 21 of the Second-Hand Goods Act 6 of 2009 requires that all motor vehicle dealers maintain a Second-Hand Goods Register. This register must include:

• Details of every acquisition and disposal of vehicles

• Confirmation and recording of microdot information.

Microdot verification involves inspecting the vehicle, identifying, and confirming the microdot using the microdot industry interface, and ensuring compliance with the relevant standards.

If a vehicle does not meet the fitment requirements, the dealer is responsible for arranging re-fitment.

Training on verification, fitment, and use of the interface can be provided by Microdot manufacturers upon request.

We urge all affected members to:

• Ensure you are compliant with Regulation 56 and the Second-Hand Goods Act,

• Register your dealership or workshop as a Microdot Fitment Centre if applicable,

• Maintain proper records as required by law.

SAPS has advised that it will be inspecting that the second hand vehicle register includes microdot information. If the police official finds that the dealer has failed to keep a proper register of record that dealer can be found guilty of an offence and up to ten years imprisonment.
